SUMMARY:Treasury\, IRS release guidance on the prevailing wage and apprenticeship requirements for increased credit and deduction amounts under the Inflation Reduction Act
DESCRIPTION:WASHINGTON — The Department of the Treasury and the Internal Revenue Service issued final regulations today on the prevailing wage and apprenticeship (PWA) requirements related to increased credit or deduction amounts for certain clean energy incentives\, enacted as a part of the Inflation Reduction Act (IRA). \nThe IRA provides increased credit or deduction amounts for taxpayers who satisfy certain PWA requirements regarding the construction\, alteration or repair of certain clean energy facilities or properties\, projects or equipment. By satisfying the PWA requirements\, taxpayers can generally increase the base amount of the credit or deduction by five times. \n“The increased credit or deduction for taxpayers meeting prevailing wage and apprenticeship requirements creates opportunities for both workers and employers\,” IRS Commissioner Danny Werfel said. “The IRS is committed to ensuring that taxpayers claiming the clean energy credits comply with all of the applicable prevailing wage and apprenticeship requirements. The additional resources the IRS has received are making a difference for our efforts to ramp up taxpayer service and enforcement\, and we will continue to build on these improvements.” \nTo qualify for the PWA increased credit or deduction amounts\, taxpayers generally need to: \n\nEnsure that laborers and mechanics employed in the construction\, alteration or repair of the facility or property\, project or equipment are paid wages at rates not less than applicable prevailing wage rates.\nMeet certain requirements related to employing qualified apprentices from registered apprenticeship programs.\nMeet specific recordkeeping and reporting requirements.\n\nThe PWA requirements apply to all contractors and subcontractors of the taxpayer who employ laborers and mechanics in construction\, alteration or repair work. However\, taxpayers claiming the increased credit or deduction are solely responsible for ensuring that the PWA requirements are satisfied. \nEnsuring that taxpayers claiming the PWA increased credit or deduction amounts have met the requirements – along with enforcing the requirements for other clean energy tax credits – is a top priority for the IRS. In the months ahead\, the IRS will dedicate significant resources to promoting and enforcing compliance with the final clean energy rules. \nThe IRS is committed to working with taxpayers\, their advisors and other stakeholders to ensure compliance\, including conducting appropriate education and outreach. The IRA funding will support efforts for effective tax administration of these novel and cross-cutting provisions. \nAs part of this effort\, the IRS also released Publication 5983\, IRA Prevailing Wage and Apprenticeship Requirements Fact Sheet PDF updated Publication 5855\, IRA Prevailing Wage & Registered Apprenticeship Overview PDF and the Prevailing wage and apprenticeship frequently asked questions. \nPublication 5855 provides a summary of the PWA requirements. The frequently asked questions provide more details about the PWA requirements and information for how to alert the IRS of suspected tax violations related to the PWA requirements. The IRS takes referrals of alleged tax violations seriously and may use the information received about potential violations in connection with any applicable audit. \nThe PWA provisions include a significant penalty framework for failures to meet the PWA requirements. The penalty structure is intended to create incentives for real-time compliance with the PWA requirements. \nGiven the potential increased credit or deduction amounts available under the PWA provisions and the significant penalties at stake\, taxpayers should consider establishing frameworks to support timely compliance with the PWA requirements\, including the associated reporting and recordkeeping requirements. To minimize the potential for mistakes and significant penalties\, taxpayers who know they intend to claim an increased credit or deduction amount through satisfaction of the PWA requirements should proactively take steps to position their project for compliance with the PWA requirements. \nThese steps could include\, but would not necessarily be limited to: \n\nRegularly reviewing payroll records.\nEnsuring all contracts require that contractors and their subcontractors adhere to PWA requirements.\nRegularly reviewing the classifications of laborers and mechanics\, prevailing wage rates\, and percentage of labor hours to be performed by qualified apprentices.\nPosting information about prevailing wage rates in a prominent and accessible location or otherwise providing written notice of prevailing wage rates to laborers and mechanics during construction\, alteration\, and repair work.\nEstablishing procedures for individuals to report suspected failures to comply with the PWA requirements without fear of retaliation or adverse action.\nInvestigating reports of suspected failures to comply with the PWA requirements.\nContacting the Department of Labor’s Office of Apprenticeship or the relevant state apprenticeship agency for assistance in locating registered apprenticeship programs.\n\nThe U.S. Department of Labor (DOL) determines the applicable prevailing wage rates for each classification of laborers and mechanics in a prescribed geographic area for a particular type of construction. For more information about prevailing wage rates please visit the Department of Labor’s website. \nTo support the IRS’s efforts in ensuring taxpayer compliance with the PWA requirements\, DOL and the IRS are working on a Memorandum of Understanding (MOU) to be signed by the end of the year. Harnessing DOL’s extensive prevailing wage and registered apprenticeship expertise\, the MOU will facilitate joint and cooperative education and public outreach and development of training content for IRS examination personnel. The MOU will also facilitate DOL’s review and comment as part of the development of PWA tax forms. Finally\, the MOU will formalize a process for DOL to share with the IRS any credible tips or information that DOL receives as to potential noncompliance with the PWA requirements. \nMore information can be found on the Inflation Reduction Act of 2022 page on IRS.gov.

DESCRIPTION:The Louisiana Workforce Commission and the Apprenticeship division\, WIOA and the Local Workforce Development collaborated to organize the first-ever Youth Apprenticeship Week at Acadian Middle School in Lafayette\, Louisiana. Thanks to the active participation of employers and Apprenticeship Sponsors in the expo\, the event was a resounding success. The expo showcased real-life scenarios\, providing invaluable insights to over 500 students from six schools in Acadiana\, ranging from 8th Grade to 12th Graders. First responders also had the opportunity to demonstrate fundamental life skills to students interested in pursuing careers in those fields. The first expo was particularly focused on students and schools in low-income areas\, aiming to broaden their career horizons beyond high school graduation. \nWe are immensely grateful to the employers and sponsors for their support\, which played a crucial role in the success of the first Youth Apprenticeship Week. SUMMARY:For Women’s History Month: Honoring YARG Women
DESCRIPTION:Despite women’s advances in the working world\, many still face barriers to employment and struggle to secure economic stability. Deterrents may include a lack of transportation\, childcare\, education or training\, gender and/or racial bias\, and perhaps a lack of confidence in their abilities. Registered Apprenticeships (RAs) and the YARG program are helping young women overcome these obstacles. \n\n\nFor Women’s History Month\, we’d like to highlight two of our hard-working female apprentices: a single mother who saw no other route for herself besides working at a fast-food chain and a student who had a goal but no path to achieving it. \nArianna\, with two young children\, found help through YARG Palo Alto College to prepare for a career path in the insurance industry. The program supported her with childcare and study sessions\, enabling her to complete two-course certifications. Although the position she was offered was stymied by her lack of transportation\, her newly found confidence remains and will undoubtedly give her a leg up when her next opportunity arises. \nBianca\, a determined high school student\, hoped to become a lawyer. When she took on a paralegal apprenticeship through CareerWise at the Office of the Prosecuting Attorney in Elkhart\, Indiana\, she had no idea that she was becoming the first registered paralegal apprentice in the nation. SUMMARY:Ophthalmic Apprenticeship in Wisconsin Responds to Growing Need
DESCRIPTION:Eye care is one of the many areas of the health sector that is struggling with a personnel shortage. The number of practicing ophthalmologists in the U.S. has been trending downward since the 1990s while the demand for doctors and technicians in the field is increasing. \n\n\nIn Madison\, Wisconsin\, SSM Health and Madison College responded to this growing need by establishing the state’s first Ophthalmic Assistant Registered Apprenticeship program to train up to seven students every year. Launched in 2023\, the program is a partnership between SSM Health\, Madison College\, and the Wisconsin Department of Workforce Development Bureau of Apprenticeship Standards. \nParticipants receive classroom instruction at Madison College and simultaneous on-the-job training at SSM Health eye care clinics. Clinical training continues for another nine months after classroom-based learning concludes. SSM Health pays the apprentices a salary and benefits as well as covering the cost of tuition\, program materials\, and the certified ophthalmic assistant exam. After completing the program\, the students work as ophthalmic assistants with SSM Health\, with a minimum two-year commitment. \n“Wisconsin continues to expand apprenticeships serving in-demand industries throughout the state\,” said David Polk\, Director of the Wisconsin Department of Workforce Development’s Bureau of Apprenticeship Standards. \nThe Ophthalmic Assistant program is an indication of the increasing interest in non-traditional apprenticeship pathways\, as businesses in many sectors seek new ways to expand their talent pools. The Department of Labor (DOL) hopes to encourage this trend. It has proposed new regulations (29 CFR part 29) that aim to expand Registered Apprenticeships beyond their traditional niche in construction and manufacturing into new industries such as medicine\, education\, and tech.
